§ 22-30. Trespass.

  • (a)

    Definitions. The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Belief of property interest means a good faith belief that the person has a possessory interest in the property as an owner, tenant, lessee, licensee or invitee.

    Premises, building, dwelling and owner or lawful possessor have the meanings given to them under Minn. Stats. § 609.605.

    (b)

    A person who does not have a belief of property interest shall not:

    (1)

    Trespass on the premises of another and refuse to depart from the premises on demand of the lawful possessor;

    (2)

    Occupy or enter the dwelling or locked or posted building of another, without consent of the owner or the consent of one who has the right to give consent, except in an emergency situation; or

    (3)

    Return to the property of another within 30 days after being told to leave the property and not return if the person is without consent of one with authority to consent.

    (c)

    Any person violating this section upon conviction shall be guilty of a petty misdemeanor.
