§ 32-131. Additional considerations.
In addition to the foregoing matters, the commission, in connection with its recommendation to the council, and the council in determining whether to approve or disapprove a proposed plat or subdivision, shall specifically and especially consider the following matters:
(1)
Whether the proposed plat or subdivision complies with the policies, objectives and goals of the comprehensive plan.
(2)
Whether the proposed plat or subdivision complies with chapter 36.
(3)
Whether the design of the proposed plat or subdivision, or the design or type of improvements proposed to be placed thereon, may be detrimental to the health, safety or general welfare of the public.
(4)
Whether the proposed plat or subdivision conforms to, and complies with, the requirements of applicable state law.
(5)
Whether the proposed plat or subdivision complies with the policies, objectives, goals and requirements of this chapter, as varied by variances therefrom, if any.
